Sacramento Slip & Fall Accident

One of the trouble with grocery stores is that they are trying to use less and less employees to keep cost down. One area where this is especially noticeable is the fruit and vegetable area. It is often impossible to find anyone in this section yet this is an area where fruits and vegetables often end up on the floor because they are stacked too high or they simply fall on the floor by accident. When a family comes through with small children it is understandable how a child or even an adult could slip and fall in this environment. If you or your child have been hurt in a slip, trip or fall accident, Injury Lawyer Todd Bissell has many years of experience, he can be reached at 916-458-4244.

Slip Trip And Fall Accidents

Slip Trip and Fall Accidents, in United States tort law, is a claim or case based on a person slipping (or tripping) and falling. It is a tort, and based on a claim that the property owner was negligent in allowing some dangerous condition to exist that caused the slip or trip. Property owners generally have two basic defenses to Public liability slip and fall claim. The first defense is that they were not negligent. For example, the owner may claim that the banana that a patron slipped upon had been dropped on the floor only moments ago by another patron, and that, in the exercise of due diligence, a typical store owner acting with reasonable care would not have had time to discover the danger and take steps to mitigate the danger. The second and more typical defense is that the person who was injured was at fault. For example, the owner may claim that any reasonable patron, exercising due diligence for his or her own safety, would see a banana on the floor, and take those steps necessary to avoid slipping on it. Mistake # 8. SIGN A MEDICAL RECORDS AUTHORIZATION

Do not sign one when the other driver's insurance company offers to collect your medical records for you and to provide you with copies at their cost.  They will not start with when your accident occurred.  If they think it will help in their defense, they will go back virtually to your birth.  Nor will they limit their investigation just to body parts injured in the collision.  They will collect whatever you permit them to and will use it all against you.  Protect yourself by NOT signing anything. If you need help, there is no charge for a case review Call Attorney Todd Bissell today at 916 458-4244.

Mistake #9. FAIL TO FOLLOW UP PROMPTLY WITH NECESSARY MEDICAL CARE

Most ER or Urgent care doctors will advise you to follow up with your family doctor if you continue to feel symptoms after a few days.  Do so.  If you do not, any insurance company, and likely any juror will conclude that you are fine.  If you are not fine, you need to be treated.  Studies show that accident victims who treated aggressively after an accident healed better and quicker than those who waited around thinking that they would get better on their own.  By the time that you realize that you are not healing, you may have worsened your injury and damaged your claim.

10 Biggest Mistakes You Can Make After An Accident:

5. FAIL TO GO THE THE ER BY AMBULANCE OR TO AN URGENT CARE CLINIC. If you feel dizzy, nauseous, have a severe headache, stiff neck or low back pain that might impact your ability to drive, request an ambulance to take you to the hospital. As with your car away from the scene, if you leave an accident scene without requesting any care, the other driver's insurance company will likely conclude that you suffered no more than a muscle strain. Err on the side of caution, and get yourself checked out. If you are confident that you do not need an ambulance, at least get checked out by an urgent care clinic within 24 hours of the accident. 10 Biggest Mistakes Free Case Review Call Accident Attorney Todd Bissell 916 458-4244.

My First Attorney Gave Up! Todd Took It To Trial!

"The other driver was elderly and ran a red light when he crashed into my car. He told the police that he did not know what color the light was. He later changed his story and sued me, saying that I ran the red light! Because there were no witnesses, his insurance company refused to pay for my totaled car or for my injuries. My first attorney then dropped my case. My doctor recommended Todd Bissell who agreed to take on my case. Todd fought hard for me and took my case all the way to trial. After Todd won our pre-trial motions, the insurance company got reasonable and we were able to settle the case. Thanks Todd for sticking with me when my other attorney gave up on me."

Louie Anderson Sues for Slip and Fall

By NICK DIVITO

LAS VEGAS (CN) - Comedian Louie Anderson sued a fast-food Chinese restaurant inside the Excalibur Hotel in a slip-and-fall case. Anderson's publicist pointed out that the comedian is suing the restaurant, not the Excalibur, where Anderson is performing his stand-up show, "Larger Than Life."
Anderson says he slipped while visiting Manchu Wok on March 22, 2008, in his complaint in Clark County Court. Anderson's publicist Glenn Schwartz confirmed that the former "Family Feud" host filed the lawsuit, but declined to give specifics.
